These Terms and Conditions govern the use of the website scorpiomadeira.com and all services offered by Scorpio Madeira diving center, hereafter referred to as “Scorpio Madeira”, “we”, “our”, or “the Company”.
By booking, purchasing, or participating in any activity offered by Scorpio Madeira, you agree to these Terms and Conditions.
Scorpio Madeira operates in Madeira and complies with the applicable laws and regulations of Portugal.

In person at the dive center
Some bookings may require manual confirmation by our staff before they are considered confirmed.
Booking Confirmation
A booking becomes confirmed when payment has been received or when a written confirmation has been issued by Scorpio Madeira.
For bookings made by email or direct contact, the activity is not guaranteed until confirmation is sent by our team.
Scorpio Madeira reserves the right to decline a booking request due to availability limitations, weather or sea conditions, safety considerations, operational constraints, or other reasonable circumstances.
Prices and Payments
All prices are listed in Euros (EUR) and include applicable taxes unless otherwise stated.
Payments may be processed through the booking system provided by FareHarbor, through payment links, bank transfer, or directly at the dive center by accepted payment methods.
Full payment or a deposit may be required to secure a reservation.
Scorpio Madeira reserves the right to modify prices without prior notice. Confirmed bookings remain unaffected.
Booking Changes
Requests to modify a confirmed booking must be made at least 24 hours before the scheduled activity and are subject to availability. Scorpio Madeira cannot guarantee that requested changes can be accommodated.
Participation Requirements
Participants must meet the minimum age required for the activity, be in appropriate physical and mental condition, and follow all instructions provided by instructors and staff.
Participants are required to complete all necessary waivers, medical questionnaires, or other documentation before participating in activities.
For certified scuba diving activities, participants must present a valid diving certification and may be asked to demonstrate sufficient experience or provide a logbook.
Scorpio Madeira reserves the right to refuse participation if safety requirements are not satisfied.
Medical Fitness for Diving
Scuba diving and ocean activities involve physical exertion and exposure to environmental conditions.
Participants must confirm they are medically fit to participate. When required, participants must provide medical clearance from a physician confirming their fitness to dive.
Failure to disclose relevant medical conditions may result in cancellation of participation without refund.
Safety and Instructions
Participants must follow all safety instructions given by instructors, dive guides, boat crew, and staff.
Scorpio Madeira reserves the right to terminate participation if a participant behaves in a manner that endangers themselves, other participants, staff members, or the environment.
Participants who appear to be under the influence of alcohol or drugs may be refused participation.
In such cases refunds may not be granted.
Late Arrival Policy
Participants must arrive at the designated meeting point at the specified time.
Late arrivals may miss the activity and participation cannot be guaranteed. In such cases the booking may be treated as a no-show and the full price may be charged.
Minimum Participant Requirements
Certain activities may require a minimum number of participants.
If the minimum number is not reached, Scorpio Madeira reserves the right to reschedule the activity, offer an alternative activity or date, or provide a refund.
Weather and Environmental Conditions
All ocean activities depend on weather and sea conditions.
Scorpio Madeira reserves the right to modify schedules, change dive sites, delay activities, or cancel activities when necessary for safety reasons.
If an activity is cancelled by Scorpio Madeira due to weather, sea conditions, or operational considerations, customers will be offered either a rescheduled activity or a full refund.
Cancellation Policy
Customers will receive a full refund or credit if a cancellation request is made at least 24 hours before the scheduled activity.
Customers will also receive a full refund or credit if Scorpio Madeira cancels an activity due to weather conditions, sea conditions, safety concerns, or other unforeseen circumstances.
To cancel a booking or inquire about a cancellation, customers must contact Scorpio Madeira by phone using the contact details provided on our website.
Participants who do not attend their scheduled activity and fail to notify us in advance will be considered a no-show and will be charged the full price of the booking.
Refunds may be processed through the original payment method or issued as credit for a future activity.
Bookings made through third party booking platforms such as FareHarbor may also be subject to the policies and procedures of those platforms.
Liability and Risk Acknowledgment
Participation in scuba diving and ocean activities involves inherent risks including injury, decompression sickness, environmental hazards, equipment failure, and other risks associated with water based activities.
Participants acknowledge these risks and agree to participate voluntarily.
All participants are required to sign a liability waiver and assumption of risk agreement before participating in activities.
Scorpio Madeira cannot be held responsible for incidents resulting from failure to follow safety instructions, undisclosed medical conditions, participant negligence, or circumstances beyond the reasonable control of the operator.
Insurance
Scorpio Madeira maintains the insurance coverage required by law for its operations.
Participants are encouraged to obtain personal travel or diving insurance covering accidents, injuries, or medical treatment related to adventure activities.
Equipment Responsibility
Equipment provided by Scorpio Madeira must be handled responsibly and returned in the same condition in which it was provided.
Participants may be held financially responsible for damage or loss caused by negligence, misuse, or failure to follow instructions regarding the use of equipment.
Personal Belongings
Scorpio Madeira is not responsible for the loss, theft, or damage of personal belongings during activities, transportation, or while stored at the dive center.
Participants are advised to avoid bringing valuables during activities.
Transportation and Boat Transfers
Some activities involve transportation by boat or vehicle to reach dive sites or activity locations.
Participants must follow all safety instructions provided by the boat crew or driver at all times.
Diving Safety and Flying After Diving
Participants are responsible for respecting recommended safety intervals between diving and flying or traveling to high altitude locations.
Scorpio Madeira cannot be held responsible for issues arising from failure to follow accepted diving safety guidelines.
Training and Certification Standards
Training courses follow the standards and procedures of the relevant diving certification agency.
Successful certification requires completion of all required theoretical knowledge, practical skills, and performance standards established by the training organization.
Environmental Responsibility
Scorpio Madeira promotes responsible interaction with marine ecosystems.
Participants must not touch, disturb, or collect marine life, damage coral or underwater habitats, or remove natural objects from the marine environment.
Participants are expected to follow responsible diving and environmental protection guidelines at all times.
Photography and Media
Photos and videos may be taken during activities for documentation and promotional purposes.
These materials may be used on the Scorpio Madeira website, social media channels, and marketing materials.
Participants who prefer not to appear in promotional content should inform staff before the activity begins.
Website Content
All content published on scorpiomadeira.com including text, images, logos, and branding remains the property of Scorpio Madeira unless otherwise stated.
Unauthorized reproduction, copying, or distribution of website content is prohibited.
Force Majeure
Scorpio Madeira shall not be held responsible for cancellations, delays, or changes caused by events beyond its reasonable control including natural disasters, severe weather conditions, government restrictions, port closures, pandemics, or other force majeure circumstances.
Consumer Dispute Resolution
In accordance with European consumer protection regulations, customers may use the European Online Dispute Resolution platform for disputes related to online purchases.
Governing Language
These Terms and Conditions may be provided in multiple languages. In the event of discrepancies between translations, the English version shall prevail.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Portugal.
Any disputes arising from the use of our services shall be subject to the jurisdiction of the competent courts of Funchal.
